Section 39 of the criminal justice act 1988?

l was arrested in July for an alledged ault on my flat-mate. l have which denied such charges. l was knocked out by my flat-mate unconscious and was taken by ambulance to the hospital and arrested when the doctor released me. My flat-mate is 2nd dan black belt in tae kwon do and an instructor, she is currently sewing 2 companies for the same compliant of a bad back and is also claiming against me for the same injury. My hearing date in on the 5th Feb '09, can someone please advise as l have never been in trouble with the law before?
